The democratic involution in the governance and self-regulation of Radio Televisión Madrid. The legislative modification of the Omnibus Law Two within the framework of European regulation
Abstract
The aim of this study is to examine the effects of Law 16/2023, known as “Omnibus Law Two”, on the regulation of Radio Televisión Madrid (RTVM), within the framework of the European Media Freedom Act, approved in 2024. In this regard, a comparative documentary analysis has been conducted of the legislation in question with Law 8/2015 on Radio Televisión Madrid and its subsequent reforms, as well as with the afore mentioned European regulation. “Omnibus Law two” introduces the possibility of ratifying critical decisions with absolute majorities, replacing the previous reinforced majorities. This change reduces the level of consensus required, facilitating greater political influence over RTVM. Furthermore, the transfer of powers to the CEO and the Shareholders' Meeting diminishes the Board of Directors' ability. The elimination of the representation of professional organizations on the Advisory Board compromises the diversity of voices, while the abolition of the Editorial Board centralizes editorial control, affecting internal pluralism. In conclusion, Law 16/2023 constitutes a covert repeal of Law 8/2015 because, although it has not been formally eliminated, its provisions have been significantly modified, converting Madrid's regional public television into an entity under more centralized government control.
