The Spanish Criminal Procedure Act and the Spanish Law 4/2015 on the standing of victims of crime: gaps and consequences in translation and interpreting

Abstract

Due to the increase in the migratory phenomenon, many immigrants who do not know our language need legal assistance. Nationally, there are several instruments and laws that somehow include the right to translation and interpreting in the legal field, taking into account that the immigrant may need the presence of an interpreter as a defendant, but also as a victim. However, we find that the Spanish Criminal Procedure Act and the Spanish Law 4/2015 on the standing of victims of crime contain elements that do not guarantee equal conditions in relation to justice for those who do not share the language of the court.
