The right to the integrity of the work: the mural of the San Diego Shopping Center as a case study
Abstract
This paper describes the right to the integrity of the work in the field of copyright, through
normative, theoretical and jurisprudential sources in Colombian law. The authors also propose a case
study of the first sentence of the Colombian Copyright Office. A case that demonstrates the existence of
the tension between the integrity and perpetuity of a mural as a artistic work versus its temporality and
the limitations of moral author rights. The methodology used involved the analysis of the sources cited,
and the descriptive study of the case. As results, the authors present some reflections on the right to the
integrity of the work, as well as a criticism of the second instance sentence that is currently in force.
