The essential feminist perspective in teaching, interpretation and application of law
Abstract
Introduction. This paper is based on the recognition of law as a power structure and the androcentric and patriarchal character of the Law and Legal Science. I will address how it is urgent to use gender as a tool for analysing reality in all legal processes and by all operators involved in them. Objectives. To demonstrate the importance of introducing training and awareness-raising in this perspective in law teaching and legal research. This will have a special bearing on the application and interpretation of the law, and therefore on the effective guarantee of women's human rights. Methodology. Analysis of current legislation, of feminist doctrinal contributions, using gender as a critical category. Results. We have found enormous deficiencies in training and awareness with a feminist perspective in the legal field. Conclusions and discussion. The urgency of taking gender mainstreaming seriously in legal teaching and research.
