Buying and Selling of Urban Property in Granada during the Fifteenth Century in two Arabic Notarial Documents
Abstract
The sale contract is the most exhaustively regulated contract by law of all times. For this reason, it turns out to be a useful paradigm to analyze its elements in two notarial documents written up according to Arab-Hispanic practice, and thus to compare them with the application that informs our present legal system. This comparison allows us to see that several institutions originate not only from a common inspiration based in Roman law, but from a legal logic shared by individuals without distinction of time or culture.Downloads
