Social, Political and Legal foundations of the soziale Rechtsstaat. A rereading of Herman Heller (1891-1893)
Abstract
This article will reconstruct the fundamentals of the social rule of law by sketching the main lines of Herman Heller’s legal thought. Thus, it will discuss three relevant aspects of Heller’s doctrinal contribution: a) a pluralistic conception of democracy as against nationalistic and liberalistic tenets; b) his participatory understanding of citizenship, leading to a particular perspective on state legislation and the Constitution’s normative status; and c) his criticism of fascism and dictatorship as alternatives to the rule of law.Downloads
