Un estudio sobre el caso Lava Jato (2014-2022) para una conceptualización marxista del lawfare
Abstract
The aim of the article is to analyze the conditions under which the political phenomenon known as 'lawfare' emerges. The research aims to develop a conceptualization of lawfare that goes beyond the mere description of the phenomenon and instead reveals the motives and historical conditions of its genesis. The study consists of two sections (in addition to the state of the art): first, a theoretical elaboration of categories and concepts from the Marxist tradition, with the aim of outlining the decisive socio-historical moments of the context in which lawfare is produced. Secondly, an analysis of the lawfare case known as 'Lava Jato/Odebrecht' —especially of the socio-political conditions of its emergence— as a typical case, from which analysis a system of definitions is proposed to conceptualize lawfare as a political moment in the development of the latest metamorphosis of the global capitalist system.
