Medical Liability Arising out of the Inconvenience of Egg Donation
Abstract
In this paper we show the doctrine of disproportionate damage as an alternative method to compensate egg donors’ harm. For this purpose, we study the liability derived from medical malpractice. In the work we expose: the main voices of Anthropology which have denounced that the compensation is not the true bulk of relevant damages; the current state of the legislation and what is allowed to compensate; and, finally, the alternative compensation through this doctrine resorting to case-law, which will lead us to contextualize the doctrinal categories with the particularities of egg donation.
