Abstract

Faced with changes in the uncertain future and the constant social evolution, the effort of the juridical-judicial system must be accompanied by the effort of the citizen requesting the service. We enlist in what we call the emerging paradigm, which leads to open truths abandoning monistic positivism to understand the world, always in permanent construction. Hence, for purposes of quality and effectiveness in the extrajudicial protection of rights: shared options to improve justice, no less important are the concepts of Justice and Equity to which to adhere, as from which perspective the subject refers to what is just or unjust. Also, be clear about the differences between extrajudicial and judicial mediation through the study of mediation systems for the effective protection of rights and the enforceability of agreements.
