Between Forbidden Words and Cultural History: Law and Civilisation in Ancient Greece

Abstract

In this paper, my analysis moves on a double level. On the one hand, a specific issue of Athenian law is identified, namely the reference to the ἀπόρρητα in the oration Against Theomnestus by Lysias; on the other hand, a cultural-historical issue is addressed on the basis of parts of a conference given by Louis Gernet at the Institut de droit romain in Paris, the text of which is preserved in the Archives Louis Gernet. The result is a discussion that singles out some historical-anthropological aspects within a technical question and shows well the shift, in Gernet's method, from legal sociology to a historical anthropology of ancient Greek law.
