Abstract

The legal nature of the screenplay is studied here. So it is the Spanish legal system of economic and moral rights of authors considering the screenplayer an author, according to the Intellectual Property Law in force. Some legal presumptions give place to legal duties on the scriptwriter. In other occasions, laws in force do recognize unexpected rights in favor of the screenwriter, with a view to promoting alternative uses of the screenplay.
