la libertad de comunicación pública y sus límites en el ordenamiento jurídico español the freedom of public communication and its limits in the spanish law
Abstract
This contribution characterizes the freedom of public communication within the Spanish legal system, with special attention to the limits in place to ensure respect for other legally protected property, such as the right to personal and family privacy, privacy and reputation. There are constitutional limits recognized since 1978 that have resulted in a rich jurisprudence and doctrinal debates about the precise scope of these insurmountable barriers in the exercise of the right to freedom of expression and information. Both aspects, doctrine and jurisprudence, are reviewed to identify the main contributions made on the subject since the establishment of democracy in Spain today.
