Normativa jurídico-penal sobre infancia y juventud delincuente en la dictadura franquista
Abstract
This article aims to analyse the Law of Juvenile Tutelary Courts and complementary legislation, with respect to criminal minors (younger than 16 years old). Some approaches are made to the regulation and treatment applied to known “criminal young people” (16-21). These laws are discussed in relation to the socio-political context of Francoist dictatorship. To do this, we firstly reflect on the evolution suffered by the criminal and criminological theories about the treatment that must be applied to criminal minors. We present, as well, a brief overview of changes in minor legislation, since the beginning of the tutelary jurisdiction in Spain, in order to properly contextualize the francoist laws.Downloads
