El tránsito de la oralidad hacia la escritura en la experiencia jurídica del siglo XIII: ejemplo sajón e hipótesis castellana (parte segunda)

Abstract

The possible comparations and influences between the Saxon Mirror and the legislative work of Alfonso X “the Wise” are examined, from the point of view of the medieval philosophical conception of a king of absolute wisdom who transmits this wisdom to his subjects, and of the Law that this king incarnates and protects. The good law is under the charge of the king, it comprises a tradition and has to be shown like a mirror. The work concludes with a series of reflections about the destiny, luck and vicissitudes suffered by the Alfonsine work before 1348.

On examine les possibles accords et les influences entre le Miroir Saxon et l’oeuvre législative d’Alfonso X “ le Sage ”, d’après la conception philosophique médiévale d’un roi plein de sagesse qui transmet cette sagesse à ses sujets, et du Droit que ce roi incarne et protège. Le bon Droit est protégé par le roi, fait partie d’une tradition et doit être montré comme miroir. On avance, pour concluire, une série de réflexions sur le destin et les vicissitudes de l’oeuvre alphonsine avant 1348.

In Rede stehen die möglichen Gemeinsamkeiten und Berührungspunkte zwischen Sachsenspiegel und dem Gesetzeswerk Alfons X. des Weisen, aus dem Blickwinkel der mittelalterlichen Philosophie eines von Offenheit geprägten Königs, der diese Offenheit auch an seine Untertanen weitergab sowie einer Rechtsordnung, die dieser König verkörperte und gewährleistete. Das gute Recht wird vom König gehütet, hat Anteil an einer Tradition und wird als Spiegelbild gezeigt. Es folgen schließlich noch Überlegungen zu Licht und Schatten des Alfonsinischen Werkes vor 1348.
