El delito de robo en el Derecho Penal Hispano-Musulmán
Abstract
This article is devoted to the conception of the robbery in the Hispanic Muslim criminal law: how this infraction was defined by jurists from Al Andalus, and which were its constitutive elements. It must be noted that the famous pain of “hadd”, consisting in the amputation of the right hand of the thief, was enforceable only when a series of conditions met together. In order to complete this study, a case study of the Andalusian fatwas is provided. This study offers valuable information on the judicial practice observed in Al Andalus in the matter of robbery.Downloads
