The trade companies in Seville: share capital (18th and 19th centuries)
Abstract
The share capital of a company is a key element of a partnership contract. This paper analyzes the way in which the evolution of the Ius Mercatorum’s legal culture towards the Liberal Regime and the Codifying of the Mercantile Law. This research has been carried out by means of analyzing clauses from deeds, law and doctrine. It is focused on subjects directly linked to the study of the share capital such as its exact determination, the increase and the possible reduction of it. As well as some other topics related to the share capital, as patrimonial funds available in the society, the relationship between the share capital and the legal entity, and the liability of the partner who do not invest assets in the memorandum of the association.Downloads
