Abstract

In the transformation of legal rules generated by globalization, the transnational company emerges as a hegemonic active subject. From a certain voluntary notion in the regulation of employees working conditions, on the basis of a "social responsibility" of such regulation, there has been built a space of regulation that progressively has been sliding towards negotiation with the union speaker. This paper discusses such experiences, the so-called global outline agreements, their content and their scope and extent, in the context of the emergence of new regulatory work spaces away from the traditional law-making parameters.
