The child’s best interests: assessment and perspectives of the concept at the 25th anniversary of the Convention on the Rights of the Child
Abstract
The end of the XX century experienced a change of paradigm by which Childs were seen as right holders. At that point, the State must safeguard the compliance of those rights that must be seen as same as the ones of adults. To complete this task, the United Nations Committee on Children’s Rights approved the implementation of a General Observation about Children Interest. This article aims to present the nature, scope, meaning and application of this right at the center of this General Observation, as well as related it with the Organic Law on the Legal Protection of Children and Young People.
