Minor Right Exclusion: Spain And Brazil
Abstract
In Spain, Organic Act 5/2000 gives Attorneys the power to rule a case and it is up to them to judge minors as well. Here it applies by law the principles of opportunity and adequacy. Opportunity comes when rejecting incoation of the file favouring the bettering of behaviour of the minor within a family and academic environment as well as in case of conciliation and amendment. The minor’s agreement on the given measure addresses at qualifying after the Ministry says to, always in compliance with the law. In Brazil, Act 8069/90 comprises both opportunity and conformity. Attorney here may exclude procedures, depending on circumstances or offer the minor the possibility to meet off imprisonment measures.
