Being homosexual during the Franco regime. His trace in the files of the Special Court of Madrid for the application of the Law of Lazy and Maligners (1954-1956)
Abstract
In 1954 the Law of Vagrants and Crooks undergoes a small, but important modification: homosexuals are considered dangerous subjects and institutional control will fall on them. A police and medical repression will be added to this control in order to prevent "these behaviours from spreading to other men." This article will analyse a series of files open to men accused of "homosexual acts" in Madrid (although some also include arrests in other parts of Spain) in order to analyse the different reasons why these subjects became detainees and in which cases the detention resulted in a conviction. Thanks to already existing studies in other points such as Barcelona, the Basque Country or the Canary Islands, it will be possible to compare whether there were differences in terms of the criteria for detention and conviction in different parts of the Spanish geography.
