Unas reflexiones sobre la jurisprudencia del Tribunal Supremo en relación con ‘educación para la ciudadanía’, en diálogo con Adela Cortina

Abstract

This article starts underlining the difference —made in the sentences of the Supreme Court about Education for citizenship— between what can be politically discussed and what cannot, in order to question the concepts of Public and Private Ethics. Inspired by some interesting essays of Adela Cortina, it focuses on the challenge of combining the various comprehensive moral theories and the common civic Ethics. Regarding to the procedures which bring the common goods to light, it is relevant Cortina’s calling to strengthen bonds between the logic of Alliance and that of the Contract and the rights. Finally, after referring to the category of Böckenförde, the pre-political in our constitutional States defied both by the obligation to respect the plurality and the need of integration, it stresses the importance of tradition, experience and reason in the dialogue, juridical and beyond, that our multicultural societies demand.
