La acción de la Corte Penal Internacional en Colombia; Entre legalismo y perspectiva histórica.
Abstract
Una hipotética intervención de la Corte Penal Internacional (CPI) sobre el conflicto Colombiano abriría nuevas incógnitas a un ya complicado proceso hacía la paz. La historia reciente del conflicto Colombiano nos muestra como las Fuerzas Armadas Revolucionarias de Colombia (FARC) visibilizaron a principios de los sesenta con su lucha insurgente demandas históricas del pueblo Colombiano. Sin embargo, debido al desgaste de mas de cincuenta años de conflicto, aunque dichas demandas aún no han sido escuchadas, las FARC llegaron a la mesa de negociación de la Habana con niveles de desprestigio social similares a los del estado Colombiano. En este contexto, una intervención de la CPI ha de ser analizada, no en un cortoplacismo jurídico para dar simplemente una imagen garantista del derecho internacional. De lo contrario, la CPI ha de actuar interpretando las leyes del Derecho Internacional acorde con la comprensión histórica del conflicto.
A hypothetical intervention of the International Criminal Court (ICC) in the Colombian conflict would lead the way to unforeseeable consequences in a rather complex peace process. The recent past of the Colombian conflict clarifies how the Fuerzas Armadas Revolucionarias de Colombia (FARC) insurgent fight interpreted the historical claims of the Colombians in the sixties. Nevertheless, worn out by a more than fifty years long conflict, even if the claims were not met by the Government, the FARC reached the Habana negotiating table with a strong social loss of prestige, similar to the State’s historical discredit. Within this framework, the position of the ICC has to be analysed avoiding a legalistic narrow view that would simply uphold a rights-based idea of International law. Rather, the ICC has to intervene interpreting the International legal system applicable throughout an historical understanding of the conflict.
