Abstract

The current piece of work deals with the way the Supreme Court in Spain, particularly its Social Chamber, works sometimes through reasoning and by measures of material justice when dealing with certain affairs they level with. This landmark fact, which means a certain overloading of formal justice criteria —that is to say, a mere legality, a law approval— typical of mainstream legal positivism, is clearly the one of doctrine or human interpretation of the requirements to be entitled to the pensions provided by Social Security Systems, which is the measure of material justice by the Spanish Supreme Court this study is based upon.
