Abstract

The current piece of work aims at analyzing the so-called right of option from the part of the creditor, which starts when the malevolent or culprit debtor does not follow its duties. This issue has been abundantly exploited, although usually to the same end a scholastic classic view on the right to choose of the creditor. This essay is based on the Spanish law, doctrine and case law.
