Environmental insurance and liability for damages to the environment in Argentina
Abstract
The incorporation of the environmental paradigm as a basis for achieving sustainable development has driven the need to progress on the implementation of economic instruments promoting adequate environmental protection. In this context, environmental insurance have gradually developed as instruments for internalization of environmental costs, as well as being a guarantee to the recomposition of environmental damages. In the case of Argentina, despite of having been established as a compulsory instrument, the insurance regulation has drawbacks that make it ineffective for meeting environmental objectives. This research develops an analysis of environmental insurance, in order to develop proposals for a better implementation of the insurance scheme.
