La acción de anulación frente a laudos arbitrales: especial referencia a su tramitación procedimental
Abstract
The new Arbitration Act 60/2003, as the former regulation did, allows the parties, once the arbitration award has been settled by arbitrators, to claim for its judicial control without ruling on the main question. Undoubtedly, the annulment action assures the fundamental right to legal & judicial tutelage recognized under Spanish Constitution. The main achievement of the current legal text is related to the procedure this action follows: the verbal proceeding. But such a number of special provisions and formalities have to be applied to, that in turns out to be an special proceeding.Downloads
