Compliance y posición de garante: imputación de hechos delictivos al compliance officer
Abstract
In the wake of the inclusion of criminal responsibility of legal persons and compliance programmes, several main issues within the frame of Business Criminal Law have been raised, namely the criminal responsibility by Compliance Officers. In this piece of work we will approach the legal concept of Compliance Officers and their duties. We will study the necessary requirements to be claimed for Criminal Responsibility at business on a one-to-one basis. We will then look into the subject of Compliance Officers being company delegates and whether they need to put an end or to make it difficult for company members to commit crimes. Last but not least we will study the necessary requirements for likely criminal responsibilities by default on the part of Compliance Officers.
