The legal relationship as a methodological concept
Abstract
The doctrine of the legal relationship has considered subjective rights both within substantive legal rules and within procedural law rules. An attempt is being made to use this concept in such a way that it allows describing the position of the judicial subjects in their legally foreseen connections within the situations regulated by rules. That allows dealing with the function which the subjects have as protagonists or as affected or interested parties or verifiers etc., of a specific judicial situation. The structure of the legal relationship allows including within itself not only the respective positions of the different subjects within included, but also the change of these positions as the successive actions to carry out the rights and obligations are made, according to what is set out by the rules. Therefore, the legal relationship has a static methodological application, but also a dynamic description of the subjective interactions.Downloads
