Clasificación de las normas jurídicas como enunciados de actos ilocutivos

Abstract

In this essay we analyze legal norms as linguistic statements and illocutionary speech acts, according to the ideas of Austin and Searle. We study the different classes of illocutionary force of legal statements (legal norms) and we present an outline of the various kinds of norms which compose a legal system. From this point of view, we find four basic classes of legal statements or norms, i.e.: assertive, definitory, prescriptive and performative statements.
