Abstract

The community radio stations are media which disseminate  news, discuss about community interests and also diffuse social movements. However the operation of unauthorized community radio in Brazil is seen as a crime. Thus, it's important to reflect about this question: how these radio stations can be considered criminal if they do socially acceptable work? The objective of this article is presenting the historical, legal and communicative aspects concerning the outlook of community radios in Brazil. The study is based on community radio relevance to Human Rights and the need for decriminalizing the majority of these radios. Moreover, it was made a jurisprudence research with the themes “community radio stations” and “crime”, which has found that the dominant jurisprudence still considers the operation of unauthorized community radio as a crime. However it has been also observed that one minority jurisprudence disregards community radio as an illegal exploitation.
