Dismissal arising from the lack of adaptation to new technologies

Abstract

Business modernization, driven by digitalization, automation, and the use of advanced technologies, has profoundly transformed organizational dynamics, increasing efficiency and productivity. However, this evolution has brought with it a troubling side effect: objective dismissals resulting from technological causes. This phenomenon not only leads to a labor landscape marked by uncertainty and adversity, but also exacerbates economic inequality and weakens social cohesion. This essay aims to highlight the need for a comprehensive and balanced analysis in assessing these dismissals—an analysis that goes beyond evaluating the individual worker's performance and incorporates the employer's responsibilities, as well as the constant dynamics of change inherent to technological implementation. The quality and depth of this reassessment will largely determine the solutions that regulatory frameworks and jurisprudence can provide to balance the implications of technological progress with social and labor justice.
