Minors, social networks and digital rights: a comparative approach
Abstract
Minors are especially vulnerable on social media. Therefore, the European Union has decided to develop Organic Law 3/2018 on data protection and the guarantee of digital rights as a consequence of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data. By 2026, Spain aims to implement strict protections for minors on social media, raising the minimum access age to 16 and prohibiting the use of these platforms by those under that age through the draft Organic Law for the Protection of Minors in Digital Environments. The new measures include mandatory age verification systems, free parental controls on devices, and strict restrictions in the educational and digital environment.
