Inteligencia Artificial y Propiedad Intelectual: desafíos y oportunidades en el ámbito del periodismo
Abstract
This paper examines the implications of generative artificial intelligence (GAI) in the context of intellectual property, focusing on its impact on textual, image and audiovisual works, especially in the field of journalism. As GAI tools become more advanced, the question arises as to whether these technologies can combine and transform human works to create new original productions, and in what legal context. The article analyses how GAI influences the creation and distribution of news content, as well as its repercussions on the quality and authenticity of journalism. Specific cases where GAI has been used to generate news, images and videos are discussed, assessing whether these creations should be considered copyrighted works or whether they pose a risk to jobs in the journalism sector. It also addresses the ethical dilemma facing the industry regarding the attribution and recognition of human work versus automated productions. In conclusion, the article proposes recommendations for adapting intellectual property regulations to this new technological reality, seeking a balance between AI-driven innovation and the protection of the rights of communication professionals.
